This document is a public offer (proposal) from self-employed individual Vasiluk Dmitry Vasilievich, registered as a taxpayer under Russia's professional income tax regime ("самозанятый", tax ID / INN 644201730655), hereinafter the "Provider", addressed to any legally capable individual, hereinafter the "User", and containing all essential terms for providing access to the paid features of the Tomato Timer service at https://tomatoid.net (hereinafter the "Service").
Acceptance of this offer (full and unconditional agreement to its terms) occurs when the User pays for a subscription to the Service.
1. Subject of the offer
1.1. The Provider gives the User access to additional Service features (the "Tasks" and "Statistics" sections) under a paid subscription.
1.2. Without a subscription, the User has access to a free 7-day trial from the moment of registration, as well as the basic timer functionality with no time limit.
2. Price and payment
2.1. The current subscription price (monthly or yearly) is shown on the Service's payment page right before payment.
2.2. Payment is processed through the payment partner lava.top. The Provider does not receive or store the User's card details.
2.3. The subscription renews automatically at the end of the paid period unless the User cancels auto-renewal.
3. Cancellation and refunds
3.1. The User may cancel auto-renewal at any time in their own lava.top account (the "My Purchases" section).
3.2. After cancelling auto-renewal, access to the Service's paid features remains active until the end of the already-paid period; no further charge is made.
3.3. Payment for a billing period that has already started is non-refundable, except where required by Russian law.
4. Rights and obligations of the parties
4.1. The Provider undertakes to provide access to the Service to the extent of the paid subscription and to take reasonable measures to keep it operational.
4.2. The User undertakes not to use the Service for unlawful purposes and not to attempt to disrupt its operation.
4.3. The Provider may change the Service's functionality and subscription price, notifying Users on the site at least 7 days before the change takes effect for new payment periods.
5. Liability
5.1. The Service is provided "as is". The Provider does not guarantee uninterrupted operation of the Service and is not liable for indirect losses related to its use.
5.2. The Provider's liability to the User is limited to the amount paid by the User for the last billing period of the subscription.
6. Term and changes
6.1. This offer is valid indefinitely and may be amended by the Provider unilaterally; the current version is always available at https://tomatoid.net/oferta.
6.2. Continued use of the Service after changes are made means the User agrees to the new version.
